Terms of Service
1. Introduction
Welcome to First Consultation Guide ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.
Our Services provide guidance and support for individuals seeking to navigate their first consultations in various professional fields. We offer educational resources, scheduling assistance, and preparation materials to help reduce anxiety and improve outcomes for first-time consultations.
2. Acceptance of Terms
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also acknowledge that you have read and understood our Privacy Policy, which is incorporated by reference into these Terms.
If you are using our Services on behalf of a business or other entity, you represent and warrant that you have the necessary authority to bind that entity to these Terms, and references to "you" in these Terms refer to both you individually and that entity.
3. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date at the bottom of this page. Your continued use of our Services after such changes constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically to stay informed of updates. If you do not agree with the revised Terms, you must stop using our Services.
4. User Accounts
Some of our Services may require you to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
We reserve the right to disable any user account at any time, in our sole discretion, if we believe you have violated these Terms or if your account shows signs of suspicious activity.
5. Consultation Services
Our Services are intended to provide guidance and preparation for consultations, but they do not constitute professional advice in any field, including but not limited to medical, legal, financial, or psychological advice. Any information provided through our Services is for general informational purposes only.
While we strive to provide accurate and up-to-date information, we make no representations or warranties about the accuracy, completeness, or suitability of the information contained on our website for any purpose. Any reliance you place on such information is strictly at your own risk.
We facilitate connections between users and professional consultants, but we are not responsible for the quality, safety, or legality of services provided by these professionals. Any interaction or transaction between you and a consultant is solely between you and that consultant.
6. Booking and Cancellation
When you book a consultation through our Services, you agree to honor that appointment or to cancel or reschedule in accordance with our cancellation policy. Our standard cancellation policy requires at least 24 hours' notice for cancellations or rescheduling. Failure to provide sufficient notice may result in cancellation fees or forfeiture of prepaid fees.
We reserve the right to cancel or reschedule consultations due to unforeseen circumstances, consultant unavailability, or technical issues. In such cases, we will make reasonable efforts to notify you promptly and to reschedule your consultation or provide a refund as appropriate.
7. Payment and Refunds
By providing payment information, you represent and warrant that you have the legal right to use any credit card, debit card, or other payment method that you provide. You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred.
Our refund policy varies depending on the type of service purchased. For standard consultation bookings, we offer full refunds for cancellations made at least 24 hours before the scheduled consultation time. For cancellations made with less than 24 hours' notice, we may offer partial refunds or credit toward future services at our discretion.
For subscription services, refunds are governed by the specific terms of the subscription plan you select. Generally, we do not provide refunds for subscription fees already paid, but you may cancel your subscription at any time to avoid future charges.

9. Prohibited Uses
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

10. Limitation of Liability
In no event will First Consultation Guide, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, our Services, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless First Consultation Guide, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
12. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Portugal. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Portugal, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
13. Waiver and Severability
No waiver by First Consultation Guide of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of First Consultation Guide to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
14. Entire Agreement
These Terms, our Privacy Policy, and any other terms and policies referenced herein constitute the sole and entire agreement between you and First Consultation Guide regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
